Terms and Conditions of Use
1. Contractual Relationship
MyJesto is a technology platform that connects end users ("Customers") with independent merchants ("Merchants") and independent delivery drivers ("Delivery Partners"). You acknowledge that MyJesto does not sell products, nor is it a restaurant or a transportation company. The purchase relationship is direct between the Customer and the Merchant.
2. Use of the Digital Wallet
Sole Method: MyJesto operates exclusively under a prepaid balance system within the Wallet. Neither cash payments nor external cards are accepted at the time of checkout.
Adding Funds: The user is responsible for ensuring they have sufficient balance before placing an order. Balance top-ups are subject to fraud verification processes.
Non-Refundable: Once funds have been added to the Wallet, they are not redeemable for cash, unless local law dictates otherwise. The balance is for exclusive use within MyJesto.
3. Disclaimer of Liability
Product Quality: MyJesto does not guarantee the freshness, temperature, condition, or food safety of the delivered products. This responsibility rests exclusively with the Merchant.
Delivery Delays: MyJesto does not guarantee exact delivery times. Factors such as traffic, weather, or delays at the Merchant's location are beyond our platform's control.
Third-Party Conduct: MyJesto is not liable for the acts or omissions of Merchants or Delivery Drivers.
4. Cancellations and Refunds
Orders in Preparation: Once the Merchant accepts an order, neither cancellations nor refunds of the balance to the Wallet are permitted.
Order Errors: In the event of missing or incorrect products, the Customer must report the issue via the App within a maximum of 10 minutes following delivery. Any compensation will be issued exclusively in the form of credits to the MyJesto Wallet, at the company's sole discretion. 5. Intellectual Property
All content on the platform (MyJesto logos, software, app interface, etc.) is the property of MyJesto. The reproduction, reverse engineering, or copying of the application's structure is prohibited.
6. Limitation of Damages
To the fullest extent permitted by law, MyJesto shall not be liable for indirect, incidental, special, or consequential damages—including loss of profits or data—related to the use of our services.
7. Modifications
MyJesto reserves the right to modify these terms at any time. Continued use of the application following such modifications constitutes acceptance of the new terms.
